1. General Information
These Terms & Conditions govern all agreements between Beyond Visuals (hereinafter “Service Provider”) and the Client.
These Terms apply to all photography, videography, content creation, and social media services unless otherwise agreed in writing.
Any deviation from these Terms must be expressly agreed in writing and signed by both parties.
2. Definitions
Client: Any individual, company, or legal entity purchasing services.
Service Provider: Beyond Visuals (Wanderlust Escape Trips), Business ID 2810426-6.
Content: All photographs, videos, audiovisual works, digital assets, and related materials created by the Service Provider.
Agreement: Any contract, written confirmation, invoice, or communication confirming services, including these Terms & Conditions.
License: The limited right granted to the Client to use the Content under specific conditions.
3. Services
The Service Provider agrees to provide services as defined in the Agreement.
Services may include, but are not limited to:

• Photography (interior, lifestyle, commercial)

• Videography (short-form, promotional, social media content)

• Content creation and editing

• Social media strategy and management

The scope of services is strictly limited to what is agreed in writing.
Any additional requests outside the agreed scope will be invoiced separately and are subject to availability.
4. Booking and Payment
4.1 Booking Confirmation
Bookings are confirmed only upon:

• Written acceptance of the Agreement

• Payment of a non-refundable deposit of 50%

The deposit secures the production date and compensates for lost opportunity costs.
4.2 Payment Terms
The remaining balance must be paid no later than 3 (three) days prior to the scheduled service.
Failure to complete payment entitles the Service Provider to:

• Suspend or cancel services

• Retain all payments made

4.3 Late Payment
Late payments shall incur:

• Interest in accordance with the Finnish Interest Act (Korkolaki 633/1982)

• A €40 administrative recovery fee pursuant to EU Directive 2011/7/EU

The Service Provider reserves the right to engage third-party collection agencies.
4.4 Cancellation Policy

• Deposits are strictly non-refundable

• Cancellation more than 10 days before: deposit retained

• Cancellation within 3 days: 100% of total fee payable

This reflects production planning, reserved dates, and lost business opportunities.
5. Delivery of Content
5.1 Editing
The Service Provider will deliver edited Content according to the agreed package.
Raw files remain the exclusive property of the Service Provider and are not included unless explicitly agreed.
5.2 Delivery Method
Content will be delivered digitally (e.g., WeTransfer or equivalent).
Delivery timeframe is typically within 10 days, unless otherwise agreed.
5.3 Acceptance
Delivery is deemed accepted unless the Client raises a written objection within 5 days.
6. Intellectual Property Rights
6.1 Ownership
All Content remains the exclusive intellectual property of the Service Provider under:

• Finnish Copyright Act (Tekijänoikeuslaki 404/1961)

• EU Directive 2001/29/EC

No ownership rights are transferred under any circumstances.
6.2 Moral Rights
The Service Provider retains moral rights, including:

• Right to be credited

• Right to object to derogatory treatment of the work

6.3 License Grant
The Client is granted a:

• Non-exclusive

• Non-transferable

• Revocable
  license strictly limited to agreed uses.

Commercial use requires explicit written agreement.
7. Unauthorized Use and Legal Consequences
Any use outside the agreed license constitutes copyright infringement under Finnish law.
This includes:

• Use beyond agreed duration

• Use in paid advertising without license

• Sharing with third parties

• Modification or editing without consent

7.1 Financial Liability
In case of infringement, the Client shall be liable for:
a) License Fee Compensation
Minimum 3x the standard commercial licensing fee per asset or full market value, whichever is higher.
b) Damages
Compensation under:

• Section 57, Finnish Copyright Act

• EU Enforcement Directive (2004/48/EC)

Including:

• Lost licensing revenue

• Commercial gain obtained unlawfully

• Brand and reputational damage

7.2 Legal Costs
The Client is liable for all:

• Legal fees

• Enforcement costs

• Collection costs

7.3 Injunctive Relief
The Service Provider reserves the right to:

• Demand immediate cessation of use

• Seek court injunctions

• Claim damages retroactively

8. Use of Content by Service Provider
The Service Provider retains the irrevocable right to use Content for:

• Portfolio

• Marketing

• Website

• Social media

Unless explicitly restricted in writing.
9. Social Media & Content Usage Terms
Unless otherwise agreed:

• Content usage rights are limited in duration and scope

• Rights expire automatically upon contract termination

Continued use after expiration constitutes infringement.
10. Client Responsibilities
The Client agrees to:

• Provide accurate information

• Ensure access to locations

• Obtain necessary permissions

The Service Provider is not responsible for failures caused by the Client.
11. Limitation of Liability
To the maximum extent permitted by Finnish law:
The Service Provider’s liability is limited to the total fees paid.
The Service Provider is not liable for:

• Indirect damages

• Loss of revenue or profit

• Business interruption

12. Force Majeure
The Service Provider is not liable for failure due to events beyond reasonable control, including:

• Natural disasters

• Government restrictions

• Equipment failure beyond control

13. Privacy and Data Protection
The Service Provider complies with:

• GDPR (EU 2016/679)

• Finnish Data Protection Act (1050/2018)

Data is processed solely for contractual purposes.
14. Governing Law and Jurisdiction
This Agreement is governed by:

• Finnish law

• Applicable EU legislation

All disputes shall be resolved exclusively in Finnish courts.
15. Amendments
The Service Provider reserves the right to amend these Terms.
The applicable version is the one in force at the time of Agreement.
16. Acceptance
By entering into an Agreement, the Client confirms:

• Full understanding of these Terms

• Acceptance of all conditions

• Acknowledgment of copyright restrictions

SOCIAL MEDIA MANAGEMENT TERMS & CONDITIONS
1. Definitions
Client: Entity purchasing social media services
Service Provider: Beyond Visuals
Content: All media created
2. Services
Includes:

• Content creation

• Strategy

• Posting

• Campaign management

Scope defined in Agreement.
3. Payment
Same structure as above:

• 50% deposit

• Balance due before service

4. Content Usage
License is:

• Non-exclusive

• Non-transferable

• Time-limited

Expires upon termination.
5. Ownership
All Content remains property of the Service Provider.
6. Unauthorized Use
Same enforcement applies:

• 3x licensing fee

• Damages

• Legal costs

7. Liability
Limited to fees paid.
8. Governing Law
Finnish law applies.
9. Acceptance
Binding upon engagement.
